LETTERS OF INTENT TO SEEK ELECTED OFFICE


NOTICE IS HEREBY GIVEN that candidates wishing to file their names, in writing, with the district secretary for the December 12, 2017 Walworth Fire District No. 1 Fire District Officers Annual Election are asked to send a letter to the district secretary expressing their interest in the current position and for their names to be placed on the ballot. For this year, there is one Commissioner position available that carries a term of office for five years. The deadline for submission of the petition to the district secretary is November 22, 2017. All letters are to be sent to Aimee Phillips, District Secretary, Walworth Fire District No. 1, P.O. Box 179, Walworth, NY 14568.

Public Hearing - Hamlet of Macedon Sanitary Sewer District

ORDER OF PUBLIC HEARING
     WHEREAS, on March 15, 2016, the voters of the Village of Macedon elected to approve the Village’s Plan for Dissolution, which required the Village to dissolve on or before April 1, 2017; and
     WHEREAS, the Town Board desires to establish a water district, known as the (Hamlet of Macedon Sanitary Sewer District: (hereinafter the “District”), to continue administering and providing sanitary sewer services to the residents located within the area formerly comprising the Village of Macedon; and service to the residents located within the area formerly comprising the Village of Macedon; and
     WHEREAS, the Town Board has obtained a map and plan prepared by a competent engineer, duly licensed by the State of New York, depicting the sewer system and Wastewater Treatment Plant presently service the residents located within the proposed District; and
     WHEREAS, the aforesaid map and plan is on file and available for review at the Town Clerk’s Office during regular business hours; and
     WHEREAS, the Town Board anticipates that the maximum amount to be expended annually for sanitary sewer services shall be $432,000; and
     WHEREAS, the cost of the district shall be $500 per equivalent dwelling unit, $240 of which shall be applied to capital improvements and $260 of which shall be applied to operation and maintenance expenses; and

     WHEREAS, the sanitary sewer system and wastewater treatment plant predate the creation of the District and no additional connections are anticipated within the proposed boundaries, so there are no estimated hook-up fees; and

     WHEREAS, no additional improvements or expenditures for the establishment of the District are proposed at this time; and

     Now on motion on Councilperson KENYON, seconded by Councilperson MCEWEN, all members present voting therefor, it is hereby

     ORDERED, that the Town Board of the Town of Macedon will hold a public hearing on October 26, 2017 at 8:00 p.m. at the Macedon Town Hall, to consider the establishment of the Hamlet of Macedon Sanitary Sewer District, as described above and set forth on the map and plan filed with the Town Clerk, at which time and place all persons interested in the subject thereof may be heard concerning the same, and it is further

     ORDERED, that the Town Clerk is hereby authorized and directed to publish a copy of this order in the official Town newspaper and cause a copy of the same to be posted on the signboard of the Town in the time and manner required by law.

Public Hearing - Hamlet of Macedon Water District

ORDER OF PUBLIC HEARING

     WHEREAS, the Town Board desires to establish a water district, known as the (Hamlet of Macedon Water District: (hereinafter the “District”), to continue administering and providing water service to the residents located within the area formerly comprising the Village of Macedon; and service to the residents located within the area formerly comprising the Village of Macedon; and
     WHEREAS, the Town Board has obtained a map and plan prepared by a competent engineer, duly licensed by the State of New York, depicting the proposed District, a copy of which is on file and available for review at the Town Clerk’s Office during regular business hours; and
     WHEREAS, no additional improvements are anticipated for the creation of the District; and
     WHEREAS, the Town Board anticipates that the maximum amount to be expended annually for water service shall be $469,265.20 resulting in an annual charge of $542.50 per single family home or equivalent dwelling unit, which includes debt service and cost of water, to be assessed to each such unit in the proposed District, calculated as follows:
     Water Use          $302.50 (Based on average annual use of 50,000 gal/year per unit at                          $4.25 per 1,000 gallons and $90 per year base charge)
     Capital charge          $240.00
                    $542.50
And
     WHEREAS, there is no estimated cost to connect to the water system because the water system predates the creation of the District and no additional connections are anticipated within the proposed boundaries; and

     Now on motion on Councilperson MAUL, seconded by Councilperson KENYON, all members present voting therefor, it is hereby

     ORDERED, that the Town Board of the Town of Macedon will hold a public hearing on October 26, 2017 at 7:55 p.m. at the Macedon Town Hall, to consider the establishment of the Hamlet of Macedon Water District, as described above and set forth on the map and plan filed with the Town Clerk, at which time and place all persons interested in the subject thereof may be heard concerning the same, and it is further

     ORDERED, that the Town Clerk is hereby authorized and directed to publish a copy of this order in the official Town newspaper and cause a copy of the same to be posted on the signboard of the Town in the time and manner required by law.

LEGAL NOTICE
TOWN OF MACEDON
NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN that a public hearing will be held by the Town Board of the Town of Macedon, Wayne County, New York at 32 Main Street, Macedon on October 26, 2017 at 7:45pm for the purpose of considering the contracting with the Farmington Volunteer Fire Association, Inc. for Fire protection to be furnished to a fire protection district established in said Town of Macedon and known as Macedon Fire Protection District. The general terms of the contract are as follows:

1.     The fire department of the corporation shall at all times during the period of this agreement be subject to call for attendance at any fire occurring in the Macedon Fire Protection District, and when notified by telephone otherwise by any person within the district of a fire within the district of a fire within the district, such department shall respond and attend upon the fire without delay, with at least on piece of apparatus and upon arriving at the scene of the fire, the firemen of the fire department shall proceed diligently to the extinguishment of the fire, and the saving of the life and property in connection therewith.

2.     The fire department shall at all times while this agreement is in force, furnish and provide apparatus and equipment which will comply with the requirements of Insurance Services Office of the State of New York for Class C rates.


3.     In consideration of furnishing aid and the use of its apparatus and equipment as aforesaid, the fire department shall receive the sum of $41,007.06 for the calendar year 2018, which sum the Board agrees to pay or cause to be paid on or before the last day of January, 2018.

4.     Neither the Town of Macedon nor Macedon Fire Protection District shall be liable for any loss or damage sustained to the fire apparatus or other equipment of the fire department.

5.     The Town of Macedon Shall pay any and all claims authorized by law for medical expenses, loss of wages, compensation, benefits or other claims arising by reason of the injury to or death of fireman sustained while answering, attending upon or returning from any such call, and in case the fire department shall be compelled or required to pay such claim, the Town of Macedon shall reimburse the fire department the amount paid with thirty (30) days after making such payment.

6.     Nothing herein contained shall prevent the fire department from participating in any mutual aid plans now in effect or hereafter placed in effect in Wayne County, nor prevent the fire department or the members thereof from taking party in any parade, exhibition or drill sponsored by or under the control of any duly authorized firemen’s association or department.

7.     The agreement shall continue for a period of one (1) year from January 1, 2018, and shall terminate on December 31, 2018, at midnight. However, this agreement may be terminated prior thereto upon ninety (90) days written notice after compliance with the provisions of Section 184 (8) of the Town Law.
