ZONING BOARD OF APPEALS

September 18, 2019

 

 

The Town of Macedon Zoning Board of Appeals meeting was held on Wednesday, September 18, 2019, at the Town Complex, 32 Main Street, Macedon, NY Present were Chairman Warren Jeffries, members Ronald Santovito, Brian Frey, and Deborah McEwen.  Also present was Board Clerk Brandi Schutt. Absent were Town Engineer/CEO Scott Allen, Mike Mosher and Town Councilman Bruce Babcock.

 

Chairman Jeffries called the meeting to order at 7:33 p.m.  He then explained the purpose for which the Board serves and read the Legal Notice as it appeared in the Times of Wayne County Newspaper.

 

PUBLIC HEARING:

 

Z-06-19 – Camp – 2333 Timberline Drive– Area Variance – Section 135-61-B-5 & 135 Attachment 1– Accessory Structure in front yard and side setback – Donald and Brandy Camp were present to address the Board on behalf of the application. Mr. Camp discussed how he has a current shed he built but that he cannot access it throughout the whole year due to the weather and he would like to move it to his side yard next to his home.  

                         

        Wayne County Planning Board – Referral was not required

        Planning Board – No Comment

        Town Board – No Comment

        SEQR – Not required at Appeals level

 

No one else was present to speak in favor or against the granting of these variances.  The public hearing was closed at 8:00 p.m.  

 

BOARD DISCUSSION:

 

Z-06-19 – Camp – 2333 Timberline Drive– Area Variance – Section 135-61-B-5 & 135 Attachment 1– Accessory Structure in front yard and side setback – A motion was made by Ronald Santovito, seconded by Brian Frey, to approve the variance as submitted in the application with the condition that the closest corner of the structure be a least five feet from the property line.

 

The five factors were reviewed:  There would be no undesirable change in the character of the neighborhood; benefit sought could be achieved by another method; variance was substantial; there would be an adverse impact on the physical or environmental conditions in the neighborhood; difficulty is self-created

 

Roll Vote:  Santovito – yes; McEwen – yes; Frey – yes; Jeffries – yes.  Therefore, this variance was granted with the condition that the closest corner of the structure be a least five feet from the property line.

 

 

MINUTES:

A motion to approve the 8-21-19 minutes was made by Deborah McEwen, seconded by Ronald Santovito.  All in favor; minutes approved.

 

ADJOURNMENT:

 

A motion to adjourn the meeting was made by Ronald Santovito, seconded by Deborah McEwen.  All in favor; meeting adjourned at 8:10 p.m.
