ZONING BOARD OF APPEALS

August 15, 2018

 

 

The Town of Macedon Zoning Board of Appeals meeting was held on Wednesday, August 15, 2018, 7:30 p.m., at the Town Complex, 32 Main Street, Macedon, NY.  Present were Chairman Warren Jeffries and Board members Deborah McEwen, Ronald Santovito, and Brian Frey.  Also present was Board Clerk Brandi Schutt. Absent were Mike Mosher, Town Councilwoman Sandy Pagano, and Town Engineer/CEO Scott Allen.

 

Chairman Jeffries called the meeting to order at 7:30 p.m.  He then explained the purpose for which the Board serves and read the Legal Notice as it appeared in the Times.

 

 

PUBLIC HEARING:

 

Z-06-18 – Rienholtz – 818 N. Hook Road – Area Variance – Section 135-Schedule I & Section 135-162-B – Side yard setback & non-conforming building shall not be enlarged– Steven Rienholtz was present to address the Board on behalf of the application. He explained that he would like to rebuild and expand his garage 4 feet wider and 8 feet longer. He explained that the existing garage is an eye sore and he has difficulty fitting a vehicle with the chimney being present in the garage. He mentioned that his current garage has a 10 foot setback and he is looking to turn that into a 6 foot setback with the new build.

•        Planning Board – Positive Referral

•        Town Board – No comment

•        SEQR – Not required at Appeals level

 

Robert Rienholtz was present to speak in favor of the granting of these variances.  The public hearing was closed at 7:39 p.m.  

 

BOARD DISCUSSION:

 

Z-06-18 – Rienholtz – 818 N. Hook Road – Area Variance – Section 135-Schedule I & Section 135-162-B – Side yard setback & non-conforming building shall not be enlarged – A motion was made by Ronald Santovito, seconded by Brian Frey, to deny the variance as submitted in the application.

 

Board members discussed how approving the side setback for this application would open them up for further side setback approvals. Board members believed there was not enough information on the survey map to give an approval.

 

The five factors were reviewed:  There would be no undesirable change in the character of the neighborhood; there wasn’t enough information to determine if the benefit sought could or could not be achieved by another method; variance was substantial; there wasn’t enough information to determine if there would be an adverse impact on the physical or environmental conditions in the neighborhood; difficulty is self-created.

 

Roll Vote:  Santovito – yes; McEwen – yes; Frey – yes; Jeffries – yes.  Therefore, this variance was denied.

 

MINUTES:

 

A motion to approve the 07-18-18 revised minutes was made by Warren Jeffries, seconded by Deborah McEwen.  All in favor; minutes approved.

 

 

ADJOURNMENT:

 

A motion to adjourn the meeting was made by Ronald Santovito, seconded by Brian Frey.  All in favor; meeting adjourned at 8:00 p.m.
