ZONING BOARD OF APPEALS

July 18, 2018

 

 

The Town of Macedon Zoning Board of Appeals meeting was held on Wednesday, July 18, 2018, 7:30 p.m., at the Town Complex, 32 Main Street, Macedon, NY.  Present were Chairman Warren Jeffries and Board members Deborah McEwen, Ronald Santovito, and Mike Mosher.  Also present were Town Councilwoman Sandy Pagano and Board Clerk Brandi Schutt. Absent were Brian Frey and Town Engineer/CEO Scott Allen.

 

Chairman Jeffries called the meeting to order at 7:30 p.m.  He then explained the purpose for which the Board serves and read the Legal Notice as it appeared in the Times.

 

 

PUBLIC HEARING:

 

Z-04-18 – Fox – 2687 Hance Road – Area Variance – Section 135-Schedule I & Section 135-162-B – Front yard setback & non-conforming building shall not be enlarged– Donald Fox was present to address the Board on behalf of the application. He explained that he would like to build a new covered porch that extends 12 feet from the house and 10 feet wide. The new porch would lie inside of the existing shrubbery and be 25 feet from the road.

 

•        Wayne County Planning Board – Returned to the Town to be handled as a local matter

•        Planning Board – Positive Referral

•        Town Board – No comment

•        SEQR – Not required at Appeals level

 

There was no one else to speak for or against the granting of these variances.  The public hearing was closed at 7:45 p.m.  

 

 

 

Z-05-18 – Berry Global – 200 Main Street – Area Variance – Section 1205-A – One sign per each side of building – Jeremy Miller was present to address the Board on behalf of the application. He explained that Berry Plastics is changing their logo to just Berry. He mentioned that the applicant would like to add two new signs to the property. One sign will be on the building and the other sign will be a ground sign on the corner of Route 350 and Route 31.

 

•        Wayne County Planning Board – Returned to the Town to be handled as a local matter

•        Planning Board – Positive Referral

•        Town Board – No comment

•        SEQR – Not required at Appeals level

 

There was no one else to speak for or against the granting of these variances.  The public hearing was closed at 7:54 p.m. 

 

 

 

BOARD DISCUSSION:

 

Z-04-18 – Fox – 2687 Hance Road – Area Variance – Section 135-Schedule I & Section 135-162-B – Front yard setback & non-conforming building shall not be enlarged– A motion was made by Ronald Santovito, seconded by Mike Mosher, to approve the variance per the modified application.

 

The five factors were reviewed:  There would be no undesirable change in the character of the neighborhood; benefit sought could not be achieved by another method; variance is substantial; there would be no adverse impact on the physical or environmental conditions in the neighborhood; difficulty was self-created.

 

Roll Vote:  Santovito – yes; McEwen – yes; Mosher – yes; Jeffries – yes.  Therefore, this variance was granted.

 

 

Z-05-18 – Berry Global – 200 Main Street – Area Variance – Section 1205-A – One sign per each side of building – A motion was made by Mike Mosher, seconded by Ronald Santovito, to approve the variance as submitted in the application.

 

The five factors were reviewed:  There would be no undesirable change in the character of the neighborhood; benefit sought could not be achieved by another method; variance is not substantial; there would be no adverse impact on the physical or environmental conditions in the neighborhood; difficulty was self-created.

 

Roll Vote:  Santovito – yes; McEwen – yes; Mosher – yes; Jeffries – yes.  Therefore, this variance was granted.

 

 

MINUTES:

 

A motion to approve the 06-20-18 & 6-27-18 minutes was made by Mike Mosher, seconded by Deborah McEwen.  All in favor; minutes approved.

 

 

ADJOURNMENT:

 

A motion to adjourn the meeting was made by Mike Mosher, seconded by Deborah McEwen.  All in favor; meeting adjourned at 8:03 p.m.
