ZONING BOARD OF APPEALS

September 8, 2004

 

The Town of Macedon Zoning Board of Appeals meeting was held on Wednesday, September 8, 2004, at the Town Complex, 32 Main Street, Macedon, NY. Present were Chairman Warren Jeffries, members Carl Eligh, John Gravino, Charles Packard and Ronald Santovito. Also present was Town Engineer Scott Allen. Absent was Councilman David Maul.

Mr. Jeffries called the meeting to order at 7:32 p.m. He then explained the purpose for which this Board serves and read the Legal Notice as it appeared in the Times.

PUBLIC HEARINGS:

Z-11-04 – Klino – 1048 Alderman Road – Area Variance – Section 135-61-B-5 – Shed in front yard – Mark Klino was present to explain his application. He would like to place a 14' x 24' shed at the end of their driveway turnaround on a crushed stone pad. Use will be storage of personal items, lawn & snow removal equipment, ATV & motorcycle. No commercial use. Home is approximately 250 ft. from road. Septic system & slope of land make the back yard less desirable for placement of this building. Letter of support was included from Cindy & Andrew Brychcy, 1024 Alderman Road. There was no one else present to speak for or against the granting of this variance.

Wayne County Planning Board – No intermunicipal or countywide impact

Z-12-04 – Morreale – 2843 Kittering Road – Area Variance – Section 135-61-A – Garage larger than allowed by Code – Mike Morreale of Merit Development was present to explain this application. He is constructing a new home on 10+ acres of land, and the eventual owner needs the additional garage space to house his tractors, lawn equipment and woodworking shop. No commercial use will be made of the space. There was no one else present to speak for or against the granting of this variance.

Z-13-04 – Bob Bonosky Ford, Inc. – 1241 Route 31 – Area Variance – Sections 135-190-A & 135-190-C – Signs exceeding Code for number & size – Bob Bonosky was present to explain this application. Currently signs are painted on the front windows of the dealership's showroom and side of the building. These would be replaced with building-mounted signs to meet Ford Motor Co. requirements, as well as increase visibility. One sign will be mounted on the roofline facing the street, and the second will be on the west side of the building. In addition, Mr. Bonosky two other signs (one pylon & one roof sign) had been removed. Neither of the new signs will be lighted. Mandatory NYS signs for service & inspections will be on the building front. Local competitor appears to have equal or greater number of signs. There was no one else present to speak for or against the granting of this variance.

BOARD DISCUSSION:

Z-11-04 – Klino – 1048 Alderman Road – Area Variance – Section 135-61-B-5 – Shed in front yard – Motion made by Carl Eligh, seconded by John Gravino, to approve the installation of 14' x 24' pre-assembled garage/workshop with a one-year abandonment clause. House is 250+ ft. from road; similar variance has been granted for neighbor; better access to snow removal equipment. The five factors were reviewed.

Roll Vote: Eligh – yes; Gravino – yes; Packard – yes; Santovito – yes; Jeffries – yes. Therefore, this variance is granted.

Z-12-04 – Morreale – 2843 Kittering Road – Area Variance – Section 135-61-A – Garage larger than allowed by Code – Motion made by Ron Santovito, seconded by Carl Eligh, to grant this variance. This is a large lot (10+ acres), and house is over 1500 ft. from the road. The five factors were reviewed.

Roll Vote: Eligh – yes; Gravino – yes; Packard – yes; Santovito – yes; Jeffries – yes. Therefore, this variance is granted.

Z-13-04 – Bob Bonosky Ford, Inc. – 1241 Route 31 – Area Variance – Sections 135-190-A & 135-190-C – Signs exceeding Code for number & size – Motion made by John Gravino, seconded by Charles Packard, to approve these variances as proposed in the application. Discussion followed on business signs along Route 31 and comparison with other car dealership. The five factors were reviewed.

Roll Vote: Eligh – yes; Gravino – yes; Packard – yes; Santovito – yes; Jeffries – yes. Therefore, these variances are granted.

 

MINUTES:

Motion made by Carl Eligh, seconded by Charles Packard, to approve the 8/11/04 minutes. All in favor; minutes approved.

 

OTHER BUSINESS:

There was a brief discussion with the Town Engineer regarding possible expansion of a Route 31 mini-storage facility.
