PLANNING BOARD

May 10, 2010

 

 

PRESENT:  Chairman Doug Allen, members Suzanne Airy, Mert Bartels, Mark McEwen, Tom Morrison, Kevin Rooney & Greg Whitney.  Also present were Town Councilman David McEwen, Town Engineer Scott Allen and Board Clerk Susan Bush.

 

Chairman Allen called the meeting to order at 7:33 p.m.  A motion to waive reading the Legal Notice was made by Kevin Rooney, seconded by Mert Bartels.  All in favor; motion carried.

 

PUBLIC HEARING:

 

PB-05-10 – Sapp – 1303 Victor Road – One-lot realty subdivision & residential site plan – A motion to open the public hearing was made by Kevin Rooney, seconded by Mert Bartels.  All in favor; motion carried.  Applicant Fred Sapp was present to speak before the Board.  There was no one else present to speak for or against this application.  A motion to close the public hearing was made by Kevin Rooney, seconded by Suzanne Airy.  All in favor; motion carried.

 

OLD BUSINESS:

 

PB-05-10 – Sapp – 1303 Victor Road – One-lot realty subdivision & residential site plan – Preliminary & final – Applicant Fred Sapp began his comments by saying he has accepted a purchase offer on the entire property at 1303 Victor Road, and if the transaction is completed, he will withdraw this request.  However, should the transaction not be completed, he will proceed with the subdivision.  Board then discussed the application and asked for clarification on the location of the existing septic system for 1303 Victor Road.  System is located in the front yard and well within the boundaries of the proposed subdivision line.  The Town Engineer stated he had received comments from a resident who was concerned about the proposed septic on the new lot and the elevation of a nearby pond.  He reviewed the perc rates (reasonably fast), and explained the proposed site would be suitable for slab construction, a raised ranch or house with a crawl space.  A motion for negative SEQR declaration was made by Mert Bartels, seconded by Kevin Rooney.  All in favor; motion carried.  A motion to grant preliminary/final subdivision and site plan approval per the application was made by Greg Whitney, seconded by Kevin Rooney.  All in favor; motion carried.

 

ZBA REFERRALS:

 

Z-02-10 – Johnson – 2894 Daansen Road – Area Variance – Section 135-61-B-5 – Shed located in front yard – Board would prefer to see the shed placed in the rear yard in compliance with Town Code.

 

Z-03-10 – Sacco2260 West Walworth Road – Area Variance – Section 135 Sched. I (Attach. 1) – Front setback for porch addition – Board had no concerns with this application.

 

OTHER BUSINESS:

 

Calvary Chapel – 1675 Wayneport Road – Proposed move to 1704 Wayneport Road – Board gave a positive recommendation for continuing this use in ORM zoning.

 

MINUTES:

 

A motion to approve the 04-12-10 minutes was made by Mert Bartels, seconded by Suzanne Airy.  All in favor; minutes approved.

A motion to adjourn the meeting was made by Suzanne Airy, seconded by Mert Bartels.  All in favor; meeting adjourned at 8:00 p.m.
